1. The service

Pony Soft is a web-based management platform for courier and pony express agencies, developed and distributed by Paraschiv Cristian Vasile PFA ("we", "us"). The software is installed on the customer's own hosting environment and is accessed through a web browser.

2. Licence

Each purchase grants a single, unlimited licence bound to one domain. The licence permits use of the software on that domain for an unlimited time and for an unlimited number of users, unless otherwise agreed in writing.

The licence does not permit reselling, sublicensing, redistributing or making the software available to third parties outside the licensed domain.

3. Prices and payment

Prices are those published on this website at the time of purchase, expressed in euro and exclusive of VAT where applicable. Payment terms are agreed at the time of order. The licence is activated after payment has been received.

4. Setup, training and support

Each package includes setup and installation on the customer's hosting, on-site training and a period of support with updates, as described in the selected package. After the included period expires, support and updates may be renewed under a separate agreement.

5. Customer obligations

The customer is responsible for providing a suitable hosting environment that meets the technical requirements communicated by us, for safeguarding access credentials, and for the lawfulness of the data processed through the software.

6. Intellectual property

The software, its source code, its documentation and all related materials remain the exclusive property of Paraschiv Cristian Vasile PFA. No intellectual property rights are transferred with the licence.

7. Warranty and liability

We warrant that the software substantially conforms to its documentation. We will correct reported defects within a reasonable time during the support period.

To the maximum extent permitted by law, our total liability arising from or related to the software is limited to the amount paid for the licence. We are not liable for indirect damages, loss of profits or loss of data caused by improper use, third-party hosting failures or force majeure.

8. Changes to these terms

We may update these terms from time to time. The version published on this website at the time of purchase applies to that purchase. Material changes will be communicated to active customers.

9. Governing law and jurisdiction

These terms are governed by Italian law. Any dispute arising from these terms or from the use of the software will be subject to the exclusive jurisdiction of the competent Italian courts, without prejudice to mandatory consumer protection rules.
